Terms of Service

These Terms of Service ("Terms") govern your use of ortopylot.com, the free assessment tool, and any product or service offered by Ortopylot. By using the website, submitting an idea to the assessment, signing up to our emails, or buying a product, you agree to these Terms.
If you do not agree to these Terms, do not use the site or its services.
1. Who we are
These Terms are an agreement between you and:

References to "we", "us", and "our" in these Terms mean Ortopylot. References to "you" and "your" mean the person using the site or buying a product.
2. What we offer
Ortopylot provides a free interactive assessment tool, written content, email newsletters, and paid digital products (prompts, templates, guides) for small business owners and ecommerce founders.
The site and its services are provided on an "as is" basis. We may update, change, or remove any part of the service at any time.
3. Who can use Ortopylot
You may use Ortopylot if:
- You are at least 16 years old
- You have the legal capacity to enter into a contract
- You are not prohibited from using our services by any applicable law
- Your use is for lawful purposes only
If you are using Ortopylot on behalf of a business or organisation, you confirm you have authority to bind that business or organisation to these Terms.
4. The free assessment
The free assessment is an AI-generated commercial readiness analysis of a business idea you submit. It is provided for general informational and educational purposes only.
Important things to understand about the assessment:
- The assessment is not financial, legal, accounting, business, or professional advice.
- The assessment is not a guarantee of business success or failure.
- The assessment is generated by an AI model based on the limited information you provide. It cannot replace proper due diligence, professional advice, or your own commercial judgement.
- The assessment may contain errors, omissions, or limitations inherent to AI-generated content.
- You are responsible for any decision you make based on the assessment.
By using the assessment, you agree that:
- You will not rely on the assessment as the sole basis for any significant business or financial decision.
- You will seek independent professional advice before making such decisions.
- Ortopylot is not liable for any decision you make based on the assessment, except where liability cannot be excluded by law.
5. Paid products
We offer paid digital products including prompt packs, templates, and guides. Specific terms for each product are set out at the point of purchase.
The Commercial Foundation Pack. The Commercial Foundation Pack is a one-off digital product priced at 27 US dollars (USD). It is a set of prompts and templates for working through the commercial foundation layer of an ecommerce business: who the customer really is, the real problems that customer has, the positioning that sets the brand apart, and the brand standards that keep it consistent. Payment is processed by Stripe, and Ortopylot holds no card details. The Pack is delivered digitally to the email address used at purchase, immediately or within a short period after payment. When you buy the Pack you may use the materials for your own purposes and your own business. You may not reproduce, resell, redistribute, or republish them. The no-guarantees wording in section 8 and the limitation of liability in section 9 apply equally to the Pack and to any paid product. Nothing in these Terms excludes any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded. Refunds for the Pack are governed by our Refund Policy.
General terms applying to all paid products:
- All prices are in US dollars unless stated otherwise.
- Payment is processed by Stripe. By purchasing, you agree to Stripe's terms and acknowledge that Stripe handles your payment information directly.
- Once payment is successful, we will deliver the product to the email address you provided, typically within minutes.
- Digital products are delivered electronically. No physical product is shipped.
- Refunds are governed by our Refund Policy, which forms part of these Terms.
6. Acceptable use
You agree to use Ortopylot only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the service.
You must not:
- Submit content that is unlawful, defamatory, threatening, harassing, obscene, or otherwise objectionable.
- Submit content that infringes any intellectual property right, privacy right, or other right of a third party.
- Use the assessment tool or any other Ortopylot service to abuse, harm, defraud, or mislead any person.
- Attempt to gain unauthorised access to our systems, our service providers' systems, or any other user's data.
- Use automated tools, bots, scrapers, or similar mechanisms to access the site or the assessment, except as permitted by our robots.txt or with our written permission.
- Resell, redistribute, or repackage any Ortopylot product or content without our written permission.
- Use the AI assessment for repeated, abusive, or commercial bulk-testing purposes that go beyond legitimate personal evaluation of business ideas.
- Reverse engineer or attempt to extract the prompts or methodology behind the assessment or any Ortopylot product.
We may suspend or terminate your access to the service if we reasonably believe you have breached this section.
7. Intellectual property
What Ortopylot owns. All content on the site, all assessment prompts, all templates and prompts inside paid products, all branding and design, and all underlying methodology are the intellectual property of Ortopylot or its licensors. Buying a product does not transfer ownership of the underlying IP to you.
What you can do with our paid products. When you buy a paid product (for example, the Foundation Pack), you receive a limited, personal, non-exclusive, non-transferable licence to use that product for your own business or that of a single client you work with. You may not resell, sublicense, redistribute, or share the product with anyone outside your direct use.
What you own. You own the business idea you submit to the assessment, and you own any output you generate by running our prompts in your own AI tools (for example, the customer profile or brand standards you produce by running the Foundation Pack prompts in Claude). Ortopylot does not claim ownership of your inputs or your generated outputs.
Our licence to your submissions. When you submit a business idea to the assessment, you grant us a non-exclusive licence to use that input for the purpose of generating your assessment, storing the record, sampling for internal quality and safety review, and (in aggregated, de-identified form) understanding general patterns in submissions. We do not use your submissions to train AI models, and we do not sell or share your submissions for advertising purposes.
8. Disclaimers
To the maximum extent permitted by law, Ortopylot makes no warranties, representations, or guarantees about the site, the assessment, or any paid product, beyond those that cannot be excluded under Australian Consumer Law or any other applicable law.
In particular, Ortopylot does not warrant that:
- The assessment will be accurate, complete, or fit for any particular purpose.
- The site will be available without interruption or free from errors.
- Any business idea or strategy described in our content will lead to financial success.
- The Anthropic AI model or any other service provider will be available at any specific time.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded.
9. Limitation of liability
To the maximum extent permitted by law:
- Ortopylot's total liability to you for any claim arising out of or relating to these Terms, the site, the assessment, or any paid product is limited to the amount you paid us in the twelve months immediately before the claim arose, or AUD $100, whichever is greater.
- Ortopylot is not liable for indirect, consequential, special, punitive, or incidental damages, including loss of profit, loss of revenue, loss of business opportunity, or loss of data.
- These limitations apply whether the claim is based on contract, tort (including negligence), statute, or any other legal basis.
For consumers in Australia: these limits do not apply to liability that cannot lawfully be limited under the Australian Consumer Law. Where Ortopylot is liable to you for a failure to comply with a consumer guarantee in respect of goods or services that are not of a kind ordinarily acquired for personal, domestic, or household use, our liability is limited (at our option) to: re-supplying the services, paying the cost of re-supply, replacing the goods, repairing the goods, or paying the cost of replacement or repair.
10. Indemnity
You agree to indemnify Ortopylot, its officers, employees, contractors, and service providers against any loss, damage, cost, or expense (including legal fees) suffered or incurred as a result of:
- Your breach of these Terms.
- Your misuse of the site, the assessment, or any paid product.
- Any claim by a third party arising from content you submitted.
11. Suspension and termination
We may suspend or terminate your access to the site or any service at any time if we reasonably believe:
- You have breached these Terms.
- Your use poses a security or operational risk to the service.
- We are required to do so by law.
You may stop using Ortopylot at any time. If you have purchased a paid product, your licence to that product continues subject to the terms of purchase, unless we terminate it for breach.
Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date and, where appropriate, notify you by email or through a notice on the site.
Your continued use of the service after a change means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of Western Australia, Australia. You and Ortopylot submit to the non-exclusive jurisdiction of the courts of Western Australia for any dispute arising out of or relating to these Terms.
For consumers: nothing in this section prevents you from bringing a claim in the courts of the jurisdiction in which you live if local law gives you that right.
Before going to court: we encourage you to contact us first at hello@ortopylot.com. Most issues can be resolved quickly without formal proceedings.
14. General
Severability. If any part of these Terms is found to be unenforceable, the rest of the Terms continue in force.
No waiver. If we do not enforce a right under these Terms, that does not mean we waive that right.
Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and Ortopylot in relation to the use of the site and its services.
Assignment. You may not assign or transfer your rights under these Terms. We may assign or transfer our rights if we restructure, sell, or merge the business, on giving you reasonable notice.
